*Terms and Conditions for Using Ember.jobs SMS Service**

**1. Acceptance of These Terms**

By signing up for or using the ember.jobs SMS-based job assistant service (“Service”), you agree to these Terms and Conditions (“Terms”) and our Privacy Policy. This is a binding agreement between you and **Eloquent Analytics, LLC d/b/a ember.jobs** (“ember.jobs,” “Company,” “we,” or “us”). If you do not agree with these Terms, you should not use the Service. Users may receive a link to these Terms during sign-up and your continued use of the Service signifies your acceptance.

**2. Description of Service**

Ember.jobs provides a free SMS text message assistant designed to help you with job searches, career resources, and related information. By texting with our Service, you can receive job listings, employment information, career tips, and referrals to local resources. **We are not an employer or a staffing agency**, and we do **not** guarantee that using our Service will result in any job offers or employment. The Service uses automated systems (including AI/chatbot technology) to respond to your inquiries. We strive to provide helpful, accurate information, but **the content is for informational purposes** and **ultimate decisions (such as hiring or job outcomes) are made by third parties** outside of our Service.

**3. User Eligibility**

You must be at least 13 years old to use this Service. If you are under 18, you should only use the Service with the permission and supervision of a parent or legal guardian. By using the Service, you confirm that you are legally able to consent to receive SMS messages on the phone number you provide, and that it is your own number (or you have the account holder’s permission). You also agree that you will only use the Service for personal, non-commercial job-seeking purposes and not on behalf of anyone else unless authorized.

**4. Opt-In Consent to SMS Communications**

Our Service is delivered via text messages. By providing your phone number and actively opting in (for example, by checking an opt-in box on our website or by texting a designated keyword to our number and confirming), you **consent to receive SMS messages** from ember.jobs at the phone number you provided. These messages may be sent **using an autodialer or automated system**, and may include: job search results, job alerts, tips or advice, prompts for additional information, and occasional updates about services or resources that can help with your employment search. Message frequency will vary based on your interaction with the Service (for example, when you ask a question or request job leads, you will receive response messages). **Your consent to receive text messages is not a condition of any purchase**, as our Service is provided free of charge. You understand that by opting in, you are initiating an ongoing text conversation with our automated assistant, and you are responsible for any messages you send to us as well (see Section 8 on User Obligations). If at any time you wish to withdraw consent, you may do so by following the opt-out procedures in Section 6 below.

**5. Cost and Fees**

Ember.jobs does not charge users any fee for using the Service – it is provided **completely free** from our side. However, **standard message and data rates may apply** from your mobile phone carrier. You are responsible for any fees your telecommunications provider may charge for text messaging, data usage, or overage. These charges are billed by and payable to your carrier, not to ember.jobs. If you are unsure about your texting plan or data charges, please check with your carrier before using the Service. We are not liable for any texting or data charges you may incur. (For most users on unlimited texting plans, there may be no additional cost, but this will depend on your agreement with your carrier.)

**6. Opt-Out and How to Stop Messages**

You may **opt out** of the SMS Service at any time if you no longer wish to receive messages. To opt out, simply reply **“STOP”** to any ember.jobs text message. After we receive a STOP message from you, we will send a confirmation text to let you know you have been unsubscribed, and thereafter you will not receive further SMS messages from us unless you re-subscribe. You can also opt out by contacting us at **[legal@ember.jobs](mailto:legal@ember.jobs)** with your phone number and request to unsubscribe, or by using any account settings or web portal we provide for managing your communication preferences. If you opt out via email or web, please allow a short processing time for us to remove your number. Upon opting out, the conversation history will be closed and the Service will be inactive for your number.

If you change your mind and wish to **resume** the Service, you can re-opt in by texting **“START”** (or another provided re-subscribe keyword) to our number, or by signing up again on our website. By doing so, you consent to resume receiving messages under these same Terms.

**7. Help and Support**

If you need assistance with the Service or have questions, you can reply **“HELP”** to any ember.jobs message. You will receive a reply with information on how to contact support or how to manage your subscription (for example: “Reply STOP to unsubscribe, or email [legal@ember.jobs](mailto:legal@ember.jobs) for assistance.”). We will do our best to respond to support requests in a timely manner. Please note that sending a HELP request will not unsubscribe you; it will only trigger an informational response. **8. User Obligations and Acceptable Use**

When using ember.jobs, you agree to use the Service responsibly and only for its intended purpose of personal job search assistance. **By using the Service, you agree that you will:**

* **Provide truthful, necessary information** about yourself when prompted (for example, job preferences or location), and not misrepresent your identity or intentions. This helps us tailor the job search results for you.

* **Use the Service for lawful purposes.** You will not use the SMS Service to send or receive any unlawful, harassing, defamatory, obscene, or otherwise inappropriate content. This includes not posting or transmitting any content through the Service that is offensive, abusive, threatening, pornographic, or that promotes illegal activities or discrimination.

* **Refrain from sharing sensitive personal data** that is not needed for job search assistance. We will never ask for confidential personal identifiers like Social Security numbers, financial account information, passwords, or similar sensitive information. You agree not to send such information via the Service. (For example, when creating a resume with our assistant, general education and work history details are fine, but do not send government ID numbers or highly sensitive data over SMS.)

* **Respect the integrity of the Service.** You will not attempt to spam, phish, or overload the Service with excessive messages. You will not use any automated systems or scripts to interact with our Service in a way that could damage or impair it.

* **Not attempt to hack or misuse the system.** You agree not to probe, scan, or test the vulnerability of our systems or networks, not to attempt to gain unauthorized access to the Service or any related systems, and not to knowingly introduce viruses or malicious code.

* **Not reverse engineer or tamper with the Service.** The technology and software behind our SMS assistant (including any AI components) are the property of ember.jobs and its licensors. You agree not to copy, modify, decompile, or reverse engineer any part of the Service.

* **Use your own phone number and update us on changes.** You should only opt in with a number that you personally use. If you change or deactivate your phone number, please either opt out from the Service (by texting STOP) before you lose access to that number, or notify us of the number change. This is important so that someone else who might get your old phone number is not inadvertently receiving messages meant for you. You agree that ember.jobs is not responsible for any messages that you fail to receive or that someone else receives as a result of your failure to update your number or opt out.

* **Comply with all applicable laws and regulations** (for example, telephone consumer protection laws, if applicable to you) when using our Service. You are responsible for the content of your communications through the Service.

If you violate any of the above obligations or any other provision of these Terms, we reserve the right to suspend or terminate your access to the Service (see Section 13 on Termination). You may also be subject to legal consequences if your use of the Service violates the law.

**9. Privacy and Data Use**

Your privacy is very important to us. We collect and use personal information only as necessary to operate and improve the Service, in accordance with our Privacy Policy (available on our website). Key points about our data practices include:

* **Information We Collect:** When you sign up for ember.jobs, we collect your mobile phone number and any information you voluntarily provide through the SMS conversations (for example, your name, job preferences, location, or any other details you share about your employment background or needs). We do **not** require you to submit any sensitive personal identifiers (such as Social Security numbers, driver’s license numbers, or financial information) for using the Service, and we request that you do not include such information in your messages. We also automatically receive basic technical information such as message timestamps and status (to know if messages were delivered). If you signed up via our website, we may have collected your email or IP address at sign-up as well (as described in our Privacy Policy).

* **How We Use Your Information:** We will use the information you provide **solely to deliver and support the job assistance service**. This includes using your details to search for relevant job openings, to personalize the advice or resources we send, and to remember context from past conversations so we can better assist you. For example, if you tell us your preferred job type, we will use that to filter future job suggestions.

* **No Unauthorized Sharing:** We do **not sell, rent, or share** your personal information with third-party marketers or unaffiliated companies. We will never provide your phone number or personal details to an employer or anyone else without your explicit consent. The data you provide is kept within ember.jobs and its trusted service providers as described below.

* **Third-Party Service Providers:** We use certain third-party services to help us operate the Service. Notably, we use **Twilio (Programmable Messaging)** or a similar SMS gateway to send and receive your text messages. This means your messages and phone number pass through their system, which is bound by contract to use that information only for delivering our messages and not for any other purposes. We may also use cloud hosting or AI processing services to handle your requests (for example, language processing to understand your questions and compose responses). Any such service providers are used in compliance with applicable data protection laws and are required to protect your data and only use it to provide services to us (not for their own use). Please note that **we do not own or control third-party websites or content** that we might refer you to. If you click a link we provide, you will be accessing a third-party site at your own risk. Those third-party sites have their own terms of use and privacy policies, which we encourage you to review. Ember.jobs **does not endorse or guarantee** the accuracy, quality, safety, or legality of content on third-party sites, nor the outcome of any opportunities listed there.

For example, if we send you a link to a job posting on an external job board, that posting is created and maintained by someone outside of ember.jobs. We can’t guarantee it is still open, that the description is accurate, or that you will secure the job. Similarly, if we tell you about a nonprofit program or resource, we provide that info in good faith based on available data, but you should verify details (such as eligibility, schedules, or any costs) with that organization directly.

**We are not responsible for**:

* Any content, advertisements, products, services, or information on third-party websites.

* Any transactions or interactions you have with third parties that were suggested by our Service (for instance, communications with a potential employer, or signing up for a program through a partner organization).

By using the Service, you acknowledge that **finding employment can depend on many factors outside of our control**. Ember.jobs cannot and does not promise that you will achieve any particular outcome (such as a job placement) through the use of our Service.

**12. Disclaimers of Warranties**

Ember.jobs provides this SMS Service to help you, but there are important limitations to understand. **The Service (including all information, content, and features provided via our SMS assistant and any related website or materials) is offered on an “as is” and “as available” basis, without any warranty of any kind** – either express or implied. To the fullest extent allowed by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, regarding the Service. This includes, but is not limited to:

* **Accuracy and Reliability:** We **do not warrant that the information or results you obtain through the Service will be 100% accurate, complete, current, or reliable**. While we work hard to provide useful and up-to-date information (for example, current job openings, or correct addresses for resources), we rely on third-party sources and automated processes that can contain errors or delays. The AI assistant may occasionally generate responses that are incorrect or not perfectly suited to your query. You should independently verify important information before relying on it. Use the information from the Service as a guide, not an absolute authority.

* **Availability:** We make no guarantee that the Service will be **uninterrupted, timely, secure, or error-free**. Also, any **translations** (if we support multiple languages) are provided for convenience with no guarantee of accuracy.

We encourage you to report issues or feedback to us, but we cannot promise any specific fix or improvement timeline.

**13. Limitation of Liability**

To the maximum extent permitted by law, **Eloquent Analytics, LLC (ember.jobs) and its officers, directors, employees, agents, affiliates, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages** arising out of or relating to your use of (or inability to use) the Service. This includes, without limitation, any loss of employment opportunities, lost wages, lost data, loss of goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

We are **not liable for any actions you take or decisions you make based on information provided by the Service.** You alone are responsible for evaluating the accuracy, completeness, and usefulness of any content provided, and for any outcomes of pursuing job opportunities or advice given by the Service.

In particular, ember.jobs shall not be liable for:

* **Failed or Delayed Messages:** Any failure or delay in the delivery of SMS messages, or any unintended omission or duplication of information in those messages. (For example, if a carrier outage prevents you from receiving a job alert in a timely manner, or if a technical glitch causes an answer to not reach you or to be sent multiple times, we are not responsible for any impact this may have.)

* **Third-Party Conduct:** Any conduct, content, or services of third parties that we may link to or refer you to (such as employers, websites, or service providers). If an employer fails to respond to your application, or a website mishandles your data after you click a link, ember.jobs is not liable for those third-party actions.

* **Accuracy of Information:** Errors or inaccuracies in the information presented by the Service (e.g., an incorrect job listing detail or an outdated resource phone number), or any actions you take in reliance on incorrect or incomplete information. We encourage you to verify critical information with original sources; our liability for any inaccuracies is disclaimed as above.

* **Personal Injuries or Emotional Distress:** While we sincerely hope our Service only has positive effects, we are not liable for any personal injuries, emotional distress, or other harm that might arise from your use of the Service or inability to secure employment. (For example, if a user becomes upset due to not finding a job quickly or due to something the AI said, we will work to improve the Service, but we are not legally responsible for that emotional outcome.)

* **Aggregate Cap on Liability:** In any event, to the extent any liability is found despite the above disclaimers, **the total cumulative liability of Eloquent Analytics, LLC and ember.jobs to you for all claims arising from or related to the Service is limited to **\$100 USD** or the amount you have paid us in the past 12 months for the Service (which is likely \$0, since the Service is free), whichever is greater.** This limitation applies no matter how many claims or forms of action are involved (contract, tort, strict liability, etc.), and regardless of the failure of any limited remedy.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are in such a jurisdiction, some of the above limitations may not apply to you to the extent disallowed by applicable law. However, in all cases our liability is limited to the fullest extent permitted by law.

**14. Indemnification**

You agree to **indemnify, defend, and hold harmless** Eloquent Analytics, LLC (d/b/a ember.jobs) and its affiliates, and each of their respective employees, officers, directors, consultants, and agents, from and against any and all third-party claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and court costs) that arise out of or are related to: (a) your use of the Service or any information obtained from the Service; (b) your violation of these Terms or of any applicable law or regulation; or (c) your infringement or violation of any rights of any other person or entity in connection with your use of the Service.

In plain terms, this means if your actions (for example, misusing the Service, sending prohibited content, or providing us a phone number that isn’t yours without authorization) result in a legal claim or expense against us by someone else (such as a telecom carrier, another user, or any third party), you will be responsible for the costs and damages. For instance, if you provided a phone number that does not belong to you and that person files a complaint or lawsuit because they received our texts without consent, you agree to cover any resulting costs or damages we incur.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate reasonably with us in such an event. This indemnity obligation will survive the termination of your use of the Service and/or these Terms.

**15. Service Modifications and Termination**

*Service Changes:* We are continually working to improve ember.jobs and adjust to our users’ needs. Therefore, **we reserve the right to modify, suspend, or discontinue** the Service (in whole or in part) at any time, with or without notice. This includes changing or removing certain features, adjusting how the chatbot functions, changing the phone number or short code from which we send messages, or temporarily halting the Service for maintenance or upgrades. We will try to communicate major changes via our website or through the Service when feasible (for example, texting you a notice of an upcoming significant change), but we are not obligated to maintain the Service for any minimum period. You acknowledge that the Service may evolve and that features or availability may change.

*Your Termination:* You can terminate your use of the Service at any time by opting out (texting STOP as described above in Section 6). This will cease all messages from us until and unless you opt in again. You do not need to take any further action to cancel the Service beyond opting out. *Our Termination/Suspension:* We may, at our discretion, **terminate, suspend, or restrict** your access to the Service (or certain features of the Service) at any time if we believe you may be violating these Terms or for any other operational or security reason. For example, if we detect misuse of the Service (such as spamming our number, attempting to hack the system, or sending inappropriate content), we may suspend your number from texting our Service. We may also terminate the Service entirely for all users if needed (for instance, if we cease operations or migrate to a different platform).

In most cases of individual suspension due to suspected misuse, we will attempt to notify you (e.g., via SMS or email) that you have been suspended or terminated and possibly provide a means to contact us if you believe it’s in error. However, we are not required to provide advance notice. During suspension, you will not receive further messages and may not be able to interact with the Service.

If the Service is terminated permanently (either entirely or for you as an individual), Sections of these Terms that by their nature should survive will continue to apply. This includes, but is not limited to, the provisions on Privacy, No Guarantee, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other clauses that impose obligations or limit rights after termination.

**16. Carrier and Network Disclaimer**

The Service relies on telecommunications networks and third-party carriers to deliver SMS messages. By using ember.jobs, you acknowledge and understand that:

* **Carrier Participation:** Delivery of SMS messages is subject to effective transmission by your mobile carrier. Not all mobile carriers may support our Service (though we endeavor to use broadly supported channels). The list of supported carriers may change. We are not responsible if your carrier or device is incompatible with our Service.

* **No Carrier Liability:** **Mobile carriers are not liable for delayed or undelivered messages**. Once we submit a message to be sent to you, it is largely in the control of mobile networks. There can be factors such as coverage issues, carrier systems, or device settings that cause a message to be delayed or lost. You agree not to hold us or your carrier liable for any technical issue in SMS delivery.

* **Message Security:** SMS is not an end-to-end encrypted medium. While carriers take measures to secure their networks, SMS messages could potentially be intercepted or accessed by your carrier or parties with access to the network. By using SMS, you accept these inherent risks. If you are concerned about confidentiality of certain information, consider whether SMS is the appropriate channel for that information. (Again, we emphasize not sending sensitive personal data via SMS.)

* **Short Code/Number Changes:** We may send messages from a specific phone number or a short code. On occasion, we might change the number or short code we use (for example, if we transition to a dedicated short code or if a number is decommissioned). We will try to inform you of any change. You acknowledge that if you send messages to an outdated number or code, we may not receive them. Always refer to our latest message to see the number it came from, and use that for replies. If you’re unsure, contact us via email for clarification.

* **No Emergency Use:** Our Service is not intended for emergency communications. **Do not use ember.jobs to seek help in an emergency (e.g., calling 911 services)**. We do not monitor messages 24/7, and our responses are automated and focused on job assistance. For any situation involving immediate personal safety or similar, contact appropriate emergency services.

**17. Intellectual Property Rights**

All content and materials available through the ember.jobs Service, including text, graphics, logos, button icons, and the compilation of data (such as the arrangement of job listings or resource information we provide), are the property of Eloquent Analytics, LLC or are used by us with permission. Our **trademarks, logos, and service marks** (including “ember.jobs” and any related branding) are our proprietary assets. You do not have any right or license to use our intellectual property without our express written consent, except as necessary for using the Service in accordance with these Terms (for example, you can view and read the text messages we send you, but you can’t copy our content for commercial use).

The underlying software, algorithms, and **AI technologies** that power our chatbot are also protected by intellectual property laws.
