# Ember.jobs Privacy Policy

Eloquent Analytics, LLC d/b/a Ember.jobs (referred to as "Ember.jobs", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information from users of our website and SMS/text messaging services (collectively, the "Service"). By using our Service – including signing up on our website with your phone number or opting in via text message – you consent to the practices described in this Privacy Policy.

## 1. Information We Collect

**Information You Provide:** We collect personal information that you knowingly provide when interacting with our Service. This includes:

* **Contact Information:** When you create an account or sign up for our Service, we collect information such as your name, email address, and **mobile phone number** (required for our text messaging program). ## 3. SMS/Text Messaging Program

One of the core features of Ember.jobs is the ability to receive job alerts and communications via SMS text messages. We take care to ensure our text messaging program is compliant with industry best practices and Twilio’s requirements for outbound communications. Below is important information about our SMS program:

* **Opt-In Consent:** We will only send you text messages if you have explicitly **opted in**. You may opt in by providing your mobile number on our website and affirmatively agreeing (e.g., checking an opt-in box) or by texting our dedicated number with a specific keyword (such as "START") to join. By opting in, you consent to receive recurring text messages from Ember.jobs related to our services and your job search. We keep a record of your consent (such as form timestamps or the content of your opt-in text) as required.

* **Message Content and Frequency:** Once opted in, you will receive **text messages relevant to your job search**, such as new job listings matching your profile, application status updates, interview reminders, or tips for improving your job hunt. We do **not** send promotional or marketing texts on behalf of third parties – all texts are service-related and from Ember.jobs. **Message frequency** may vary depending on your activity and preferences; for example, you might receive several job alerts in a week when new matches are found, but fewer messages at other times. (Typically, users receive between 1-5 messages per week, though this can change based on usage.) We always strive to only send messages that are timely and necessary for the service you expect.

* **Carrier Charges:** Standard **message and data rates may apply** to messages we send, as dictated by your mobile carrier plan. Ember.jobs does not charge any additional fees for the SMS service, but you are responsible for any fees from your carrier (such as text messaging or data charges). There are no premium messages; all are standard SMS or MMS.

* **Identification:** Every text message you receive from us will clearly indicate that it is from **Ember.jobs** (either by the sender ID or within the message content) to ensure you know who is contacting you.

* **How to Opt Out:** Your participation in our SMS service is **voluntary**, and you can opt out at any time. To stop receiving text messages, you can simply reply **“STOP”** to any Ember.jobs text. When we receive a STOP request, we will promptly remove you from the SMS distribution list for that program and you will no longer receive texts. * **Help Instructions:** If at any time you need assistance or more information about our SMS service, you can reply **“HELP”** to any of our texts, and we will respond with instructions on how to manage your subscription or contact customer support. We adhere to all applicable laws and guidelines for SMS communications, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. This means we only text users who have given consent, we include required disclosures, and we honor all opt-out requests immediately. Our goal is to ensure that the messages you receive are **expected and wanted**, in line with Twilio’s Messaging Policy and carrier requirements.

## 4. How We Share Your Information

**No Selling or Unwarranted Sharing:** We do **not** sell, rent, or share your personal information (including your mobile number) with third-party companies for their own marketing or promotional purposes. In fact, **no mobile information will be shared with third parties or affiliates for marketing/promotional purposes**. This is a fundamental part of our privacy commitment and also a compliance requirement for our SMS service. All other data categories we collect *exclude* text messaging originator opt-in data and consent; **this information will not be shared with any third parties**.

**Service Providers:** We may share your information with a few **trusted third-party service providers** solely to operate and support our Service (under strict confidentiality and security obligations). For example, we use Twilio, a cloud communications platform, to send and receive SMS messages on our behalf. Twilio will process your mobile number and message content only as needed to deliver our text messages to you; it does *not* use that information for its own purposes. Likewise, we might use reputable hosting providers for our website or databases, or an email service to send out account notifications. These service providers are bound by contracts to protect your data and only use it for the specific services we have requested (e.g. communication delivery, data storage, etc.). We ensure any vendor we engage adheres to privacy and security standards consistent with ours.

**Legal Compliance:** We may disclose information about you if required to do so by law or lawful order – for instance, in response to a subpoena, court order, or other government demand. We will only share the minimum necessary information and only when we have a good-faith belief that such disclosure is legally required or necessary to protect our rights, your safety, or the safety of others.

**Business Transfers:** In the unlikely event that Ember.jobs (Eloquent Analytics, LLC) undergoes a business transaction such as a merger, acquisition, or sale of assets, user information (including personal data) might be transferred to the successor entity. You can close your Ember.jobs account at any time, and we will delete or anonymize the personal information associated with your account (except for data we are required or permitted to retain by law, as noted in the Data Retention section). Keep in mind that removing your data may limit or eliminate our ability to provide the Service (for instance, if you delete your phone number, we cannot send you job alerts via SMS).

* **Privacy Preferences:** If we implement any preference center or privacy settings on our site, you can use those controls to manage how your data is used (e.g., toggling certain notifications on/off). We will respect any settings or preferences you communicate to us, within the scope of applicable law.

* **Do Not Track Signals:** Our website does not currently respond to "Do Not Track" browser signals, due to lack of a standard in how to interpret them. However, we limit our use of tracking to what is described in this Policy (we do not track your activity across third-party sites for advertising).

If you are a resident of certain regions (such as California or the EU), you may have additional privacy rights under local laws (like the CCPA or GDPR), including the right to not be discriminated against for exercising your privacy rights. While our service is currently focused on the U.S. and we do not actively offer it in those regions, we will endeavor to honor applicable requests. Our Service – including the website and SMS job alerts – is **not intended for children** under the age of 13. We do not knowingly collect personal information from anyone under 13 years old, in compliance with the U.S. Children’s Online Privacy Protection Act (COPPA). If we learn that we have inadvertently collected personal data from a child under 13, we will promptly delete that information.

Furthermore, our job matching services are generally aimed at adults in the workforce. If you are under 18, you should use Ember.jobs only with the involvement of a parent or guardian. We may explicitly restrict users under 18 from opting into the SMS service or creating accounts, as many job opportunities require adult eligibility. ## 9. International Users and Data Transfers

Ember.jobs is operated from the United States and is **intended for users in the U.S.** only. All of our systems and service providers are based in the U.S., and **your data will be stored and processed on servers located in the United States**. If you are accessing our Service from outside the U.S., be aware that you are transferring your personal data to the U.S. which may have different data protection laws than your country. By providing your information or using our Service, you consent to this transfer and processing in the U.S.

We do not actively market or provide services to users in other countries at this time. We do not knowingly collect data from individuals in the European Union or other regions with comprehensive data laws. If you are an international user who nonetheless uses our Service, you may contact us with any privacy-related requests, and we will do our best to accommodate them within the bounds of U.S. law and our internal policies.
